A major concern for law firms that are considering whether or not to take the legal process outsourcing (LPO) plunge is that of data protection. Client confidentiality is so rooted in the legal culture, and is such a fundamental aspect of professional legal ethics, that the mere notion of a pair of eyes glimpsing data from across the Atlantic and Pacific oceans sends shivers up the spines of many lawyers. Yet the ironic part is that there is a group of entities whose obsession with security issues may make that of attorneys seem a trivial thing - the outsourcing companies themselves. The building and maintaining of relationships with current and future clients is the lifeblood for service providers.

As outsourcing becomes more widespread and competition in the marketplace grows, the ability to illustrate the existence (and continued use) of powerful safeguards will increasingly become one of the significant factors for companies that are deciding which provider to link up with. Consequently, the leading outsourcing companies take security concerns extremely seriously, which may explain why many domestic studies have shown that the outsourcing process is no less secure, and may in fact be even more secure, than having the same services performed in-house.

Process fidelity is definitely necessary in the legal arena, but this needs to be placed in perspective. While legal documentation does sometimes consist of sensitive information, the sensitivity often stems from the defining characteristics of litigation and practice procedures. Law firms are no different from other companies in that they do not like to have their business practices broadcasted to the general public. However, concerning the type of damage that can be caused by leaking of information, legal data is in general substantially less sensitive than other types of data that have been outsourced for years on a massive scale. When the fact that large banks, financial institutions, and even the IRS are outsourcing on an extended basis, the entire issue of data protection insofar as LPO is concerned is put into clearer perspective. Suddenly, summons and complaints and discovery materials take on a whole new light when attorneys digest the fact that extensive credit histories, records of financial transactions and tax forms are being processed by the millions overseas.

However, this is not to say that legal information should not be afforded the highest degree of protection, especially regarding issues of conflict of interest. The legal community is one that is tightly bound together and thrives on the flow of information between affiliates and adversaries. On a regular basis, members of the defense bars network with members of the plaintiff bars. Moreover, many of the same lawyers frequent the same courtrooms in the same venues, and attend the same continued legal education courses and alumni events. Thus in order to be supremely effective, outsourcing models must place great emphasis on separation of competing interests.

The question therefore becomes: How can a law firm be assured that they are not outsourcing work to a company that is also working on the same matter for opposing counsel? While the chances of this happening may be somewhat slim, it is still a viable concern. The fact that most providers are obligated to keep the identity of their clients confidential makes it difficult for a firm to ascertain whether a current adversary is outsourcing work to the same provider.

Protections for the outsourcing firms can certainly be put into place. First and foremost, the contract between provider and client should make it absolutely clear that the provider must inform the client as soon as it learns of any possible conflict issues.

Second, the firm should make sure that the provider it chooses is able to clearly articulate - and, if possible, demonstrate - the security safeguards it has implemented to ensure the validity of the process. These safeguards should be included in the statement of work agreement, in list format, along with the additional provision that the security devices must be maintained for the breadth of the contract. Thus determination of liability of the contracting parties for any security breach that results in measurable damages will be easier to ascertain.

Third, due to the fact that technology and business procedures must often become intertwined in order for the outsourcing process to run efficiently, the security program used by the vendor should exist on both the physical and virtual levels for it to be as comprehensive as possible. It would be somewhat contradictory for an outsourcing company to rely on the fact that the production staff for two adverse law firms exists in separate offices, on separate floors or even in different cities. The very premise behind the outsourcing process is that physical separation is not a complete bar to the sharing of information - as such, a company cannot on one hand praise the concept that geographical differences are no longer barriers to the exchange of information and data, while relying strictly on geographical barriers as the only security measures put in place by the company. There is no doubt that physical separation of the production staff for adverse businesses is a good step; however, virtual separation is needed as well in order to create a robust security model.

Important questions that law firms may need answered before an outsourcing program is initiated include: How does the provider structure their production units? Are these units separated, and if they are, along what lines does the separation occur? What is the architecture of the physical premises where the work takes place? What kind of office equipment exists in that location? What types of things are prohibited from being brought to the work site? What tracking and auditing features are used in the technology that allows the process to take place? Who is responsible for the tracking and auditing? The general rule of thumb is that if the question is important enough for the attorney to ask, then it should be included in the written contract.

Once the above questions and issues are addressed to the inquiring firm’s satisfaction, the ties can be loosened and the dress shoes put on the desk, because one major aspect of the outsourcing phenomenon has been resolved. True, other issues do abound, but this one is a biggie. If the security concerns can be alleviated, then one huge step has been taken towards reaching the ultimate goal of commencing a mutually beneficial business relationship.

When determining criteria for decision matrix software for NASA one must consider the over all project needs. If Artificial Intelligent computers are to help make important decisions that could mean life or death for lunar colonies, astronauts or base stations, they must be honest, programmed using reality based criteria and be void of human emotion.

If we are design a business decision matrix for the best type of system to provide life support for the colony, thru mining local resources to make water, oxygen and hydrogen and other gases for fuel to create a self sustaining system then these criteria must take into account many critical factors such as;

1.) Weight of the machines needed to be transported for Mining

2.) Cost of components

3.) Shape of components due to shipping

4.) Number of robots needed to build facility

5.) Power supply needed to run system

6.) Waste disposal of anything not used

7.) By-product uses and storage

8.) Time to Build Components, Robots and System

9.) Simplicity due to Murphy’ism

10.) Miscellaneous hazards and dangers

11.) Deployment timeline

These of course will not be the only important criteria, there will be others; what else needs to be considered; which criteria would you give the most consideration? If we are to set let’s say a numerical number to each criteria for our decision matrix how much should each get and why? If NASA reviews 1000 possible proposals then you can see why such an artificially intelligent decision matrix system is needed and why it is paramount to keep the system fair so that not necessarily does the lowest bidder win the right to design and build the system, but that the structural integrity is sound and can be free from Murphy’ism. Think on this.

Imagine opening your appointment calendar software and asking the question, “When did I create my expense report this month?” and then being able to go to your appointment calendar and find the date on the appointment calendar in the monthly view. Hold it! The reason you can find the report on the appointment calendar is not for the reason you might be thinking.

The date the report file was created is not on the calendar because you manually typed it in, no, it is on the calendar because you created the report and attached it to the calendar on that date. Not only is it attached to that date but you can also open it from that date with a simple menu selection!

In following paragraphs, you will learn the details of how this feature works.

First, you click on an appointment calendar date text box. Second, you select from a menu the option: “add an attachment” and then the appointment calendar software opens a dialog box that allows you to browse to the directory when your template file is located and then select it.

The template file is nothing more that an empty or near empty file that you will start with to do your task. In our example the template will be for an expense report.

The appointment calendar software will then make a copy of the template as a “working copy” for you. You can then create your report and save it when you are done. When you need to save it outside of the appointment calendar software management system just open the expense report and perform a “Save As” action.

Once you have created an expense report template, you can use it over and over on other days just by selecting “open template” from the menu.

As you can see, an appointment calendar software program can be more than a passive application if designed with interactivity beyond its traditional borders. You also see that a boost in productivity can be obtained just by giving documents that were traditional organized by directory a new organization which is based on the calendar date it was created. Furthermore, you have a graphically appealing, user friendly interface by which to access your documents which enriches your work experience so that you can get things done quicker and easier.

Microsoft Business Solutions Great Plains serves multiple industries in the US, plus it has strong presence in Latin America, U.K., Australia, Canada, Middle East, South Africa. Great Plains is natural solution for growing company, when small business accounting application, such as QuickBooks, M.Y.O.B, Peachtree, Quicken or others should be replaced with ERP, better positioned to serve mid-size business. With the switch to Microsoft Great Plains you need to decide on data migration and conversion. Let us give you highlights on your options:

•	Beginning Balances approach. This is the simplest way. What you do is - enter beginning balances in Great Plains General Ledger (GL) and begin using your new system. When you need to enter invoice for existing customer - you create customer record in Great Plains and go ahead with Invoice in Accounts Receivables or Sales Order Processing (SOP). The same symmetric procedure is for vendor invoices in Purchase Order Processing (POP)

•	Master Records migration. If you have large number of customers and vendors, plus multiple addresses for customers, numerous inventory items, sophisticated chart of accounts with several thousand accounts in GL - you need to migrate these master records from your old accounting to Great Plains. The best way is - purchase Great Plains Integration manager and do it in-house or with minimal help from external consultant. If Integration Manager license seems to be expensive and you have SQL expertise in your IT group - you could your programmer populate master tables: GL00100, RM00101, RM00102, PM00200

•	Open & Work Data Migration. In Great Plains Accounts Receivables and Accounts Payables invoices have open status if payments are not yet applied to these documents. We recommend you to use integration manager to bring customer and vendor invoices and payments and post them in Great Plains. This way will allow you to save on consulting services and keep good relationship with you Microsoft Business Solutions Partner. We do not recommend using SQL scripts for bringing open data into Great Plains - you will have posting issues, related to incorrect distributions. In other words do not populate such tables as SOP10100, SOP10200 via direct SQL stored procs.

•	Historical Data Migration. We recommend stay away from this migration unless it is absolutely necessary - you may have order takers needing immediate access to customer historical records to place new order. In this case having two system: legacy accounting for data lookup and Great Plains for new documents - may not be efficient. Then you do direct historical tables population: SOP30200, SOP30300, etc.

•	Data Conversion. Conversion means the process of extracting data from your legacy application and massaging it to be ready to be fed to Great Plains. In case of each specific system you should use specific approach. In case of QuickBooks you simply print reports, save them in text file and massage there - usually in Excel or Lotus 1-2-3. The specific of small accounting applications is proprietary database platform, which makes traditional tools, such as ODBC connection complicated.

Document Manager and Version History

In previous articles I have discussed the usefulness of a document manager, such as groupware, in organizing document sharing. I have also discussed the role that a Version History plays in a good document manager. In this article I wish to elaborate on Version History and its ability to make or break your document manager. The reason a document manager benefits so much from Version History is that Version History presents a visual flow chart of the editorial process any document has gone through. The who, what, when, where, and how are all answered.

Having Version History as one of your document manager tools creates a three-point advantage in document collaboration, advantages that take businesses to a higher level of efficiency, organization, and communication.

Ad Hoc Management

Business communication and document collaboration move too quickly with the ease of Microsoft Outlook and other email communication, where any presentation or document can be shot back and forth between any number of parties any number of times. Because of the simplicity of this process, it is difficult for a document manager to track all of the editorial changes made to documents without Version History. In other words, the jumble of unordered, chronologically challenged changes are difficult, if not impossible to organize without Version History. Version History helps to present a chronological order of ad hoc business. A document manager that uses Version History will be able to work the way your business does.

Reference

As I mentioned before, as document versions are sent back and forth in no particular order, a document manager can only do so much without the help of Version History. Eventually deadlines fall due, and the various document versions need to be organized before they are brought together into one final draft. The most common process for organizing attached drafts is to dig through your email box and hard drive to collect all of the drafts and to sort them by date. Then, you ask everyone else to do the same and send them to you. Once all of the information comes back to you, you have to go over the same process again, this time deleting duplicate files. Already, too much time has been spent referencing all of the document changes. Version History references documents immediately upon request, displaying exactly where documents were sent, when they were sent, and how versions relate to each other. Version History helps to create a document manager that works for you.

Digital Thread Technology

Every tool a document manager utilizes has its own tricks. Version History is no exception. What is its trick? Digital Thread Technology. As a document is created, whether a budget plan, a marketing presentation, or a legal contract, Digital Thread Technology inserts tracking information into the metadata of the electronic document. This allows the document to be tracked over various email boxes and drives, even if the document has been sent to individuals who do not use your document manager. Digital Thread Technology literally threads each draft together like beads on a necklace, enabling Version History to create a simple and informative flow chart of your document’s draft genealogy.

How many steps does it take you to locate and open your Word documents? Try these tricks to streamline how you find and open the files you use most often:

Opening Documents

With a variety of choices, how do you open a file? Here are the standards plus several keyboard shortcuts:

• File > Open

• Open toolbar button (usually 2nd from the left on the Standard toolbar)

• [Ctrl] + O

• [Ctrl] + F12

• [Ctrl] + [Alt] + F2

Selecting More Than One File

Once you are in the Open dialog box, select more than one file to open:

• To select nonadjacent files in the Open dialog box, click one file, and then hold down [Ctrl] and click each additional file.

• To select adjacent files in the Open dialog box, click the first file in the sequence, and then hold down [Shift] and click the last file.

• To unselect a highlighted file you don’t want, hold down [Ctrl] and click the file again.

Stop Hunting For Files

Are you frequently switching to a different folder or drive when you want to open a file? Change the default folder for your documents:

1. Tools > Options.

2. Click the File Locations tab.

3. With Documents selected for File Types, choose Modify and move to the folder/drive that you use most often.

4. Finish by clicking OK twice.

Each time you start Microsoft Word, this will be the default file location but Word remembers your most recent file location each time you return to the Open dialog box during your current Word session.

Find Your Last Work

Click once on the File menu and a list of the last 4 most recently used files displays at the bottom. Save time opening up your most recent work by increasing the list to a maximum of 9 files:

1. Tools > Options.

2. Choose the General tab.

3. Look for the option, Recently used file list and increase the value to 9 files.

4. Choose OK to finish.

As you continue to open additional files, the list of recent files will expand up to the last 9 files.

Add the Work Menu

The recently used file list is great for your current documents but how do you quickly open other frequently used files? Add the Work menu to your main menu bar which makes it easy to locate important files:

1. Tools > Customize.

2. Click the Commands tab.

3. Scroll down the left column, Categories, to locate Built-in Menus near the bottom of the list.

4. On the right side column, find the Work menu choice and drag it up to the main menu. (I have mine between Window and Help).

5. Choose Close to finish.

Now, when you have an important file open, just click Work > Add to Work Menu and your document is added to the list. Your top files will then be stored as links on the Work menu regardless of their location or the last time it was opened. To open a file, choose Work to display the list.

With these tips, your files should be easier to find and open. To insure that Microsoft Word remembers the customized changes, exit out of Word, re-start and test each of these time-saving techniques.
