Army Officer Compensated for Injuries Caused During Service

A Captain in the army has been awarded compensation of £150,000 for the injuries caused to him in a car accident. He has been given the compensation under civil law. The Captain had returned to the UK from the Middle East and a soldier was given the duty of driving him to the barrack. However, the soldier fell asleep while driving and the car collided with a HGV that was moving in front of the car. The accident was so serious that fire fighters had to be called in to cut the captain out of the wreckage.

As a result of the accident, the Captain fractured his left leg at two points and also suffered from torn ligaments in the knee. Further, he cannot use the little finger of his left hand and feels numbness in the right leg. He also has pain in the chest and back. He will have to bear with Deep Vein Thrombosis, caused by the fractures, throughout his life. However, the Captain has resumed his duties by now. The Ministry of Defence admitted that it is liable to compensate the Captain and awarded him the same.

From 1987, the defence forces members who have been injured outside war or conflict can get civil compensation if they can demonstrate that negligence of the forces led to their injuries.

The Armed Forces Compensation Scheme (AFCS) repealed the War Pensions Scheme on 6th April 2005. The AFCS provides for compensation to all Regular and Reserve Forces personnel. It covers compensation for sickness, injuries and death than are connected to service if the injuries have occurred after the introduction of AFCS. The claimant has the option to file a case under civil law or under AFCS, and the compensation awarded under either claim will be adjusted under the other claim.
