Music Licensing

Music licensing can be a very confusing subject. My intent with this article is to give you enough details on what music licensing is and what are your rights to use music in advertising and / or video productions.


 


A few months ago I was contacted by a company that was celebrating 20 years in business. They wanted to put together a radio commercial that highlighted their celebration. Their request was to use Kool and the Gangs song Celebration in their radio spot. I explained to them in order to do this they would have to obtain a licensing which would cost them quite a bit of money. This was not an option for them due to their limited budget and ultimately they told me that they “went another direction” with their advertising.


 


If I had agreed to use this song without obtaining a licensing I would have put both of our companies at risk. It was not worth the risk just to make a sale. Beware that there are unscrupulous production companies that will do this type of illegal activity so the best protection you have is knowledge.


 


The copyright law protects writers of music by giving them exclusive right to their music. Once a piece of music is under copyright protection it is illegal to use it without getting permission to the owner of the copyright.


 


There are actually two types of copyrights in the United States. One is the actual copyright which is denoted with the familiar C with a circle around it. This protection is for the actual melody, lyrics and arrangement of the music. The copyright is usually owned by the actual artist that wrote the piece or their publishing company.


 


The second form of copyright is the actual recording itself. This is denoted by a P with a circle around it. This protection covers the performance of the song caught on tape or digital media and released on CD or other media. Many times a record or production company will own this performance right.


 


If you want to use a song in a production, you need obtain a Master Use license from the owner of the copyright and a Synchronization license (often called a sync license) from the owner of the performance of the song.


 


The fees for synchronization licenses vary greatly. Low-end TV usage (music is playing from car radio in a scene) can cost up to $2,000. In a film, the fee may be as high as $10,000. A popular song is worth more, possibly $3,000 for TV and $25,000 for film. A song used as the theme song for a film might get $50,000 to $75,000. Commercials can get even more money. Fees for a popular song can range from $25,000 to $500,000 plus per year. The typical range for a well-known song is $75,000 to $200,000 for a one year national usage in the United States on television and radio.


 


I think you will agree with me that that is allot of money and usually way over budget for many video and radio productions.  


 


To get around these outrageous fees, music production companies sell buyout music. When you purchase a buyout CD you do not need to obtain a licensing to use the music. You can use the music hassle free and at a much lower cost.


 


Buyout music or royalty-free, as it applies to my products, means that for your one-time purchase price, you can legally use the music in your productions for life of ownership. All copyrights of the music remain with Zebra Music LLC. My jingle licensing agreement allows a protected area of 200 miles. By doing this no other companies in a local market will have the same jingle.


 


Many other production companies offer a similar buy out music licensing. I would advise you to read the licensing agreements with other production companies and ask questions if you have concerns.


 


Network broadcast and international broadcast of buyout production music is cleared through a performance organization (like BMI or ASCAP).  The revenue that these songs produce when they are aired is paid directly from broadcast station licensing, NOT from you as a producer. These performance organizations then in turn pay each artist based on the amount their song or songs were aired on the radio or TV.

Hey You, Yes You!

So did that grab your attention, yes of course it did. Where you are right now call out , “hey”, and I am quite sure you will get a reaction, if there is no one around I bet you the dog will react.

So, what is the point?

If you are a internet marketer today, you need to literally shout out to your potential readers to get their attention. Your ad or email is going to be between hundreds of others, and if you are not going to say, “hey read me”, it will just end up in the trash.

By failing to do this, quite honestly, all your advertising efforts will be going down the drain, while your costs are escalating. Not the position you want to be in if you are planning to make any money.

Back to our calling exercise. As soon as you grab the readers attention with your headline, you have to follow it up. Keeping quiet or saying something stupid will have them gone in a flash.

When writing your headline the following is important.

Your headline must be an attention grabber. I know you have heard this a million times over, so that is why I am telling you again….and again. It is, and will always be the most important part of your ad.

Now that we have established that little point for the umpteenth time, how in the world do you go about achieving this?

One simple way is to look at the headlines of your competitors. Look at one line ad’s on web pages, headlines on sales pages, FFA pages and the emails you received.

Do this experiment with yourself, look for web pages that have one line ad’s. You will find many of them around where you can place your ad for free.

As the page opens just look at the ad that grabs your attention first, and write it down. But just use the one you saw first on each page.

Do this on about twenty different pages and you will have twenty headlines that really grabbed your attention, which in effect means that it would also grab the attention of many other people.

Now for the hard part, if you want a winning headline you are going to have to put in some work.

With these headlines before you write 30, yes at least 30 of your own headlines, either all your own words or combinations of the words and ideas you find in the 20 headlines. Remember, do not use a headline as is, it belongs to someone else.

Good, you have created your own 30 unique headlines, now for some fun time, call the dog show it to him, and go have a walk outside. You need this time and space to clear your mind and take a rest.

When, done sit down and critically read every single one of your headlines and judge them against the following criteria:

Does it say hey? Is it different to all the others you have read so far? Does it say what your product is about? Do you want to read on once you have read it? Is it exiting you?

Score each one as you read through them until you find the perfect one. You might not find it with the first read through but keep on going. Do a little bit of tweaking here and there and you will find your winning headline.

Remember not to delete the ones you are not happy with. You are not quite finished yet.

Which brings us to the second part of the headline above, “yes you” also referred to as the sub-headline. Here you need to involve the reader personally, as if this is written for only him or her. To achieve this you need to make a statement or pose a question that will arouse interest and keep them reading to the end of your message.

From your list of headlines you wrote you can now choose a sub-headline that would fit neatly with your headline. Let me explain this with an example.

Headline: “The quick and easy way to create your own money generating viral products”

Sub-headline: “You can get started in as little as 5 minutes on the road to financial freedom by using this simple 10 step formula.”

I know this was a long and hard slog to get to this point, but if you put the effort in, you will be rewarded. Now the dog has been staring at you for the whole time you spent in front of the computer, give it some loving attention.

White Noise and 10 other Soothing Sounds for Calming a Colicky Infant

The crying – oh, the crying. A colicky baby can really drive you to the edge. Failed attempts to soothe her crying may leave you wondering if you are cut out to be a parent after all. But, don’t worry, you are. You just need to arm yourself with some tools to battle each colic-crying outburst.

But, first, let’s define why your colic baby cries.

The most popular theory from scientists lately is an underdeveloped and immature nervous system. I know all women who have given birth can attest to the fact that a baby has a big head. Right?

Wrong. Actually, a baby’s head isn’t big enough to house a brain that is mature enough to have all the survival tools a human infant needs. Their brain is only the size of an apple. The birth canal cannot handle a bigger head (thank God). So, when a baby is born, the only inherent survival skills are sneezing, sucking, swallowing and….CRYING!

Most babies (80%, that is) are capable of crying for a reason, and then calming themselves down. These are usually what I call “the good sleepers” or “easy babies”. They are awake for awhile to learn and accept stimuli. Then they sleep to recover and awake to take in more stimuli.

Unfortunately, a colicky baby is usually NOT a “good sleeper” or an “easy baby”. They are high-maintenance. Their nervous system is overloaded with all the sights and sounds of a new world. And by about dinner time, they’ve had it. The crying begins. Once they start crying, they lack the mechanism to calm themselves down. In my experience, most mothers with colicky infants tell the same story. Their baby fights going to sleep. They won’t take a nap. They won’t stay asleep once they do finally go to sleep. These poor babies never take the time to recover from all the stimuli they have taken in over the course of a day.

So this is where you, as a parent, step in. Reduce the environmental stimuli and recreate the feeling your baby had while in the womb.

Remember, in the womb, your baby was packed in tightly. It was dark. It was warm. And the prominent sound she heard was the “whoosh” of blood flowing through the placenta. This “whoosh” is a little louder than the noise of a vacuum cleaner running.

However, there are other items you might have around the house that can lull your over stimulated colic baby to sleep. Most babies can be soothed by rhythmic, monotonous, low-pitched, humming sound that repeats at 60-70 pulses per minute. Here are 10 such items for you to try:

1.A shower running
2.A fan
3.A running dishwasher
4.A running washing machine
5.A very loud, ticking clock
6.A bathroom fan turned on with the light off
7.A metronome set a 60 beats per minute
8.A radio tuned to static
9.A tv tuned to static
10.Smooth jazz or easy listening stations

While listening to these rhythmic sounds, it is best to lower the lights, and make your baby comfortable. Remember, we are trying to recreate the feeling of being in the womb.

Finally, it is true what you read. Baby colic does eventually come to an end. As your baby grows, and their brains increase in size, all of the circuits mature and they learn the survival tools necessary to cope. It only takes about three to six months. In the meantime, when you feel a crying outburst about to happen, turn off the lights…and turn on all your household appliances.

Part IV- Different Types of Home Foundations and When to Use Each

The foundation is the first piece of a home to be
constructed and creates a base for the rest of a home’s
components. There are three types of foundations that are
commonly used in the U.S.: slab, crawlspace, and basement.

Slab Foundation

Slab is a type of foundation consisting of a structural concrete
slab poured directly on the grade. No accessible space exists in
slab construction. Slab foundations are popular in areas (i.e.
the Southern United States) where there is a relatively high
water table. (Water table refers to the depth in the soil at
which you find water).

Crawlspace Foundation

A crawlspace is an accessible space with limited headroom,
typically between the soil and the bottom of the first floor of
a home. Crawlspace construction is predominant in areas where
there is heavy clay content in the soil.

Basement Foundation

A basement is an accessible space between the soil and the
bottom of the first floor of a home. It usually has more
headroom than a crawlspace. Basement foundation construction is
predominant in cold climates where the foundation needs to be
situated below the frost level.

All three foundation types are usually constructed out of
concrete, but can also use concrete masonry units or insulated
concrete forms.

Concrete Masonry Units (CMUs) are hollow, concrete
blocks. To create the foundation wall, mortar is used between
blocks to hold them together, forming the wall.

Insulated Concrete Forms (ICFs) are made of rigid foam
insulation forms (a system of support assemblies, including
mold, hardware, and necessary bracing to hold concrete) into
which concrete is poured. Once the concrete has gained its full
strength, the outside forms, the inside forms, or both are left
in place to insulate the wall. ICFs are common in regions in
which the local building code requires the foundation to be
insulated. Another benefit is that the homeowner or builder is
able to finish basement immediately, without adding studs.

Choosing the Type of Foundation:

Homeowners and builders make decisions about which type of
foundation to use by gauging cost, needs/desires, and soil and
weather conditions. If you have high water tables then it may
not be possible to have a basement. If your land has shallow
bedrock or boulders then it may be more costly to dig a
basement. If you have a sloping lot it may be difficult to use a
slab foundation. If you have a cold climate then you may need to
dig down at least four or more feet to put the home’s footings
below frost level. If you have to go at least four feet deep
then it may be worth spending some extra money to dig a few feet
deeper and have a full basement. Also, it is easier to install
and maintain mechanical systems in basements (compared to a
crawlspace). Your builder can help you determine what type of
foundation is best suited for your area.

The choice of foundation is also affected by personal
preferences and costs. Basements can add thousands of dollars to
the cost of a home compared to the cost of a crawlspace.
However, when you consider the extra useable space created by a
basement it is some of the cheapest square footage space of a
home. If you are tight on funds and can’t afford the basement
then it may be a good idea to find a slightly smaller plan and
use the savings to create a basement. You’ll end up with a lot
more storage space and potential living space by doing this.

Changing the Type of Foundation on your home:

Almost any house plan can have its foundation changed. It’s
common for people to design a different foundation if the
available foundations do not suit their needs. If you are
currently working with a builder you may want to ask them if
they will take care of making the foundation changes for you.
Sometimes with foundation design it may be helpful for somebody
who is near you to do those changes because they will have more
knowledge about your local soil conditions and the slope of your
lot.

When changing foundation types, pay attention to where you will
put the furnace, water heater, and stairs. If you need to add
basement stairs, the basement stairs can usually be put under
other stairways or you may be able to replace a closet or small
room with basement stairs. Another common place to put basement
stairs is to replace a mechanical room with stairs and move the
mechanical items (such as the furnace and water heater) to the
basement. Sometimes space near the laundry room, or space near
the garage can be used for a basement stairs. Larger walk-in
closets are sometimes reduced in size to allow space for
basement stairs. You can often add a basement stairs to a plan
without increasing the size of the plan. However, sometimes
space may need to be added to a plan to provide room for a
basement stairs.

It should be noted that it is the owner’s full responsibility to
check with his/her local and state building authorities, his/her
builder, and the designer of the house plan to ensure that the
home meets all applicable building codes and requirements.

In order to prevent an accident at work that could potentially endanger someone’s life there are some guidelines that should be followed when machinery is used.

The guidelines are as follows:

Everyone using a piece of machinery should be fully trained and checklists should be used to ensure that all important points are covered

The proper guards should be used and signs displayed to remind workers to use the guards. Guards should be in place before the machinery is started

The areas around the machinery must be kept clean and tidy and free from obstructions

There should be clear space around the machinery so that the risk of accidental interference from other workers is reduced

Lighting should be sufficient around the machinery. Flickering lights should be fixed as they can cause problems with moving parts

Appropriate clothing should be worn when using machinery

If a machine is broken it should be clearly signed to prevent workers from using it and possibly causing a work accident

Body Mass Index Is Not The Only Focus of Your Weight Loss Plan. Think About The Stress in Your Mind

The first of January will bring a new group of folks out to the local gym and the fitness equipment store. Many of us have been a part of this crowd once or twice in our lifetimes. We dedicate ourselves to health and fitness as our new year’s resolution.

Whatever the motive, we have decided to drop a few pounds, start a running plan, and develop a much healthier lifestyle for a variety of reasons. We will go all out until we hit our goals, or at least until we start to miss our old ways of sleeping in and helping ourselves to another round of mother’s favorite treat.

Many mistakes will be made by fitness beginners for a variety of reasons. The biggest failures that the author has noticed are inadequate goal setting and unrealistic dreams.

There are many authors and experts who write about proper goal setting techniques, so I will let them do their work. But what we will attempt to uncover is how to envision the correct future and how best to attempt a lifestyle change that will be conducive to success in the fitness and happiness world.

First, it is most important to discover the source of the problem. Many people, including yours truly, have a tendency to open the refrigerator door excessively throughout the course of a day. This might not be a problem if the cooler were stocked with some good snacks like carrots and apples. That’s where many of us get in trouble. We are unwilling to give up the goodies we enjoy.

I have found that by expanding my culinary horizons to include fruits and vegetables, that I actually enjoy these foods. It took a little time to become more knowledgeable about these treats, but it was, and continues to be, a fun source of exploration in the grocery store.

Getting rid of all the great snack foods was tough at first, but gets easier over time. Have you ever looked at the label on a can of soda? I know a handful of people that have one open all day long. Not good. But I’m not here to criticize others.

Next, it is necessary to take the steps to fix whatever is triggering your unhealthy behavior. It’s not too hard to do, in my opinion. With the help of some inspirational books and some meditation, you will begin to realize that you can accomplish any goals you set. By waking up every morning, after a quality night’s sleep, and doing some light stretching, you won’t believe how positive you can start your day.

I recommend not turning on the morning news. Simply find a quiet spot in your home, do some toe-touches and some leg stretches. Sit in a comfortable position, and plan out your day. Just sit there for a few minutes and pay attention to your breathing patterns. Don’t let anything else interfere with this process for about 4-5 minutes.

With some practice at this, you will notice that your inner dialogue will begin to quiet, and you will be able to concentrate on the task at hand. This is a great exercise to do anytime of the day. By taking just a few minutes to yourself, your stress levels will start to drop and you will accomplish all that you wanted to in your day, and possibly much more.

Your Sure Way to Lasting Success in Trading the Markets

Why is it that some people are successful in trading the markets? And why is it some people fail? Is it luck that determines if you are successful or not in making money from the market? Is it the system or strategy that a person use which determines their success?

A lot would say that it is the system or strategy that they employ which ultimately determines if they come out winning from the market.

Every system that exists on the internet will show you how to make money using it. Without a doubt, it will make money for you. The question is usually how much money will the system make for you. All the system that out there will show to you how their system has work base on historical data or activity and then at the bottom of the page there would be a disclaimer clause that states ‘.. Historical data does not determine or guarantee future earnings….’

So why is it that these sites or page include this disclaimer clause?

The disclaimer clause is incorporated in it because they know that there are certain elements which they can not control. Human emotions.

Human emotions are always the key to either success or failure in any business. And it is no difference when trading the markets. Read all the books about trading that you want, buy all the successful system that you want. If you can’t control your emotions, you can’t succeed in the markets.

That’s the reason for the disclaimers clause because the one thing that the author can not control is their subscribers or customers emotions.

In the market there are but only two main emotions that every trader will experience; GREED and FEAR. When this emotion appears it is not how we eliminate it but rather how we act on it. There are natural emotions that can not be eliminated. This emotions forces us to action, thus how we act on it will determine the outcome.

Like anger, when we are angry at someone, it’s either we say something nasty or we can just kick a bucket or we can just dive into a pool of water. Which ever action that we take, it produces a different outcome or result.

All too often when we begin to see two to three consecutive loses on our trading activities, we would begin to have doubt. When this happens we are already at the state of fear, we fear losing more of our money and thus begin to doubt that the system is working.

While no system is absolute, meaning no system will guarantee that you will make money ALL the time. The system seller would say that we would be able to make money consistently, provided we follow their system to the dot.

On the other hand, when we begin to see two or three consecutive we begin to feel on top of the world. We begin to feel that we can start making good money from the market and then start tweaking the system or maybe putting more money in the market to leverage our earnings or maybe begin to take on more positions, which ultimately make us deviate from the system which we were using. This is when greed has already stepped in to rule our thoughts.

There is saying ‘The system is only as good as the person using it’. So if we don’t follow the system either with we are making loses or when we are creating profits. We would ultimately fail. And to follow the system requires discipline. The discipline to act on our fear and greed when it sets in, will determine how well we do in the market.

Once again discipline is the key. We must have the discipline to say ‘I have reached my target. I should take profits now even though it may go higher’ when greed sets in. And when fear sets in one should say ‘I have to take a position even though the market does not seem to be moving in my favor’

While these are but two circumstances when greed and fears arises, there are, and will be many instances when we need to make a decision to either enter or exit the market. And these are very two most important decisions to take in order to succeed in the markets. The discipline to follow the system diligently no matter what happens to the market

So no matter how good the system is, the only and sure way is to lasting success in the market depend on the discipline to overcome our personal emotional to follow a particular system religiously.

Many companies have an email address collection function in place via the web.  To improve your sign-up rates, add text below the email request box that informs your visitors of the special email benefits that they will receive (i.e. e-newsletters, purchase confirmations, delivery updates, etc.) upon registering.  You can also utilize a pop-up link to inform users of these special benefits.


Finally, your email address request function should be available on your home page. Don’t make your users go and look for it.  Every click away from your home page reduces the chances of your users taking an action and providing you with their email address information.


3.  Existing Email Database Collection


Don’t forget to ask the members of your existing customer base for email addresses of their friends, family and associates.  Viral marketing is a powerful tool to use and is extremely cost effective!  You could ask them either to provide you with additional addresses or simply to pass on your newsletter, email specific offers, or other information to others they feel have similar interests.


4.  Telemarketing Collection


Don’t assume that your telemarketing agents are asking for email addresses from potential customers.  Ensure that your agents have an updated script, which outlines the previously described benefits to potential customers of providing their email addresses.


The suggestions above are a great start!  Yet they really should be viewed as a secondary plan for building your email database.  To exponentially and expeditiously grow your email database, please read on!



EMAIL APPENDING  


Utilizing an email appending service enables you to add email addresses for up to 25% of your postal file, all within 3-4 weeks.


Email Appending - is the process of adding an individual’s email address to that individual’s postal record in side your existing database.  This is accomplished by matching the postal database against a third party, permission based database of postal and email address information.


Best Practices - Email Appending is not a prospecting tool. The DMA (Direct Marketing Association) and its interactive arm AIM (Association of Interactive Marketing) have guidelines in place that dictate that email appending only be used to append email addresses to your existing opt-in postal record house file.


The Process - Your opt-in postal file is securely transferred to an email appending provider, who will do an initial gross email address match of your file against its opt-in database of postal and email address records.  Your appending provider will then send these matches a permission-based message prepared by you.  All bounces and opt-out requests will be removed from the list.  At that point a valid permission-based email address file of your customers will be delivered back to you. 


Cost - Less than the price of a postal stamp!



IN SUMMARY


The first step of any successful email marketing effort is to build a permission-based email address list of your customers.  The simplest, quickest and most cost-effective way to do this is through email appending, which will enable you to add email addresses for up to 25% of your postal file.  Secondary efforts of email address collection via focused direct mail, web, viral and telemarketing practices are also important and will enable you to add email addresses for an additional 5% to 10% of your base on an annual basis.
